1. introduction
These Terms of Service (“Terms”) govern the use of EQ Clinic (“the Clinic”), which provides online psychiatric, healthcare, and alternative treatment services via digital platforms, including video, telephone, and chat consultations. By accessing or using the Clinic’s services, you accept these Terms and the Clinic’s Privacy Policy.

2. Processing of personal data
EQ Clinic collects and processes your personal data in connection with digital examination, diagnosis, and treatment. Processing is carried out in accordance with the GDPR, the Danish Data Protection Act, the Danish Health Act, the Authorisation Act, the Executive Order on Medical Records, and other relevant Danish healthcare legislation.

2.1 Types of Data
General personal data: name, address, contact details, personal identification number, social and family circumstances, employment and education details.

Sensitive personal data: health data (medical records, test results, assessments, etc.), sexual life, race/ethnicity, religion.

These data are processed digitally in connection with online consultations and electronic communication.

3. Purpose of Processing
EQ Clinic processes your personal data in order to:

1. Carry out online examination, diagnosis, and treatment
2. Issue prescriptions and medication orders
3. Prepare medical certificates and statements
4. Communicate with other healthcare professionals via secure digital channels
5. Request laboratory tests
6. Report data to clinical quality databases
7. Comply with statutory documentation and record-keeping obligations
8. Ensure operation, security, and performance of the Clinic’s digital systems
9. Handle complaints, inquiries, and regulatory supervision

4. Voluntary Provision of Data
When data are collected directly from you, they are provided voluntarily. If you do not provide the necessary information, EQ Clinic cannot conduct examination or treatment.

5. Sources
EQ Clinic collects data with informed consent from: yourself, other healthcare professionals, referring physicians, hospitals, electronic medical record systems, and digital healthcare registries.

6. Disclosure of Data
EQ Clinic discloses your personal data when necessary for treatment, required by law, or based on your consent. This may include sharing with other healthcare professionals, hospital laboratories, pharmacies, the Danish Medicines Agency, regional or insurance billing authorities, clinical quality databases, and public authorities.

Disclosure to relatives or insurance companies requires your explicit consent.

7. Digital communication and security
EQ Clinic uses secure digital platforms certified for healthcare communication, including secure video consultations, encrypted chat, encrypted email/messaging systems, and secure server storage. Technical and organisational security measures protect against hacking, data breaches, and unauthorised access.

8. Use of data processors
EQ Clinic uses authorised data processors, such as Therapeutbooking A/S, to operate its digital systems. Data processors act solely on instructions from EQ Clinic.

These may include electronic medical record systems, laboratory portals, accounting and auditing systems, and video platforms. Transfers outside the EU/EEA occur only where GDPR requirements are met.

9. Retention Period
EQ Clinic stores medical records and personal data for a minimum of 10 years after the last entry and longer in the event of complaints or compensation claims.

10. User Responsibility
You are responsible for providing accurate information, using secure devices, protecting login credentials, and participating from a calm and private environment. EQ Clinic may terminate or refuse treatment in cases of misuse or threatening behaviour.

11. Payment and Billing
If services are fully or partially user-paid, you accept the Clinic’s applicable fees. Treatment covered by public health insurance is billed according to applicable agreements.

Payment is made via PayPal, MobilePay, or bank transfer.

12. Your rights
You have the right to access, rectification, erasure (where permitted by law), restriction of processing, objection, data portability, and not to be subject to automated profiling. You may lodge a complaint with Datatilsynet.
